Yet a key witness to the crime left the country before Perez was set to go on trial. In December, the trial was pushed back once more, and at a hearing in January, the DA's office withdrew their indictment. Spokesman Jake Wark told Homicide Watch Boston that prosecutors had "every intention of moving forward with the case," and investigators from the DA's office worked to locate the witness through the winter.

The "previously missing" witness returned to Massachusetts recently, and Perez was indicted again on Friday.

During the indictment, Perez’s defense attorney, Rosemary Scapicchio, cited specific legal rules and said that due to “speedy trial issues," the indictment should not be happening and that the whole trial should be voided.

“We were ready to go to trial much earlier, they weren’t, and now they’re indicting him on the same charges,” Scapicchio said after the indictment. “It’s a serious violation on Mr. Perez’s constitutional rights.”

Prosecutors argued that Perez should be held without bail due to an “overwhelming amount of evidence,” which included a physical description of Perez by eyewitnesses, eyewitness testimony of his appearance in a white Ford Flex, the same car the suspect fled the crime scene from, as well as witness testimony of Perez’s reaction to the victim's death. “That’s what b***h n****** get,” Perez allegedly said after Villalona's death.

Scapicchio further argued that the defendant should not be held at all since he did not try to flee the country after he was let out on bail, and that he had met every single court appearance to date. Perez is also facing unrelated heroin trafficking charges in Suffolk Superior Court.

Although a specific trial date was not set, prosecutors and the defense agreed to set the date before April 17, 2017.
Gail WaterhouseTue, 05 Apr 2016 12:40:57 -0400http://boston.homicidewatch.org/2016/04/05/perez-re-arraigned-for-2013-murder-after-key-witness-returns/Edward VillalonaYerri PerezAccused killer of Edward Villalona had history of gun crimeshttp://boston.homicidewatch.org/2014/01/15/edward-villalona-3/
Yerri Perez, the 22-year-old Medford man accused of fatally shooting Edward Villalona in March, had a history of gun-related convictions, according to police reports.

Prosecutors claim Perez shot the 33-year-old Villalona during a confrontation on Mindon Street in Roxbury around 8:30 a.m. on March 31. He was arrested in August and pleaded innocent to all charges.

Perez, who is being held at Suffolk County Jail, is accused of murder and carrying a firearm without a license – his alleged second offense of that kind – among other charges.

In April 2010, officers arrested Perez and an associate at Mozart and Centre streets in Jamaica Plain on firearm charges, according to the police report. The officers reported that they observed a large group of people "acting suspiciously" in a nearby park and that when they approached Perez he tried to leave the area on a bicycle.

When an officer blocked his escape, Perez pulled a handgun from his waistband, the report said. The officer pushed him into a fence, forcing Perez to drop the gun, and he was arrested.

Perez, who was already on probation at the time of his April 2010 arrest, was convicted on four possession of firearm and ammunition charges.

In addition to the charges brought against him for Villalona's murder, Perez is also currently facing a separate charge of possession and trafficking of more than 200 grams of heroin, according to court documents.
Todd FeathersWed, 15 Jan 2014 21:44:53 -0500http://boston.homicidewatch.org/2014/01/15/edward-villalona-3/Edward VillalonaYerri Perez
