DA will probe man fatally shot by police in Dorchester

The Suffolk County District Attorney’s office will conduct an investigation into the fatal shooting of a man in Dorchester last week by police when officers responded to a report of a shooting.

Officers responded to 107 Devon St. around 10:30 a.m. after receiving a 911 call for a shooting. The report claimed two men had been shot inside a home near the area. When officers arrived, they allegedly found Peter Fanfan, 29, of Dorchester, helping a wounded man down the street. When an officer opened his cruiser door, Fanfan allegedly began shooting at the officer. Surveillance video and audio, which was played for local clergy, reportedly shows Fanfan shooting at police.

Officers shouted three times to the man to put down the gun, according to a pastor who viewed the video, and then the officer returned fire, fatally wounding Fanfan.

Two men were injured in the shooting that police were responding to, which the Globe reports may have been a home invasion.

Fanfan reportedly had a lengthy criminal record which included other gun charges. He also was evaluated twice at Bridgewater State Hospital for mental health issues, according to the Boston Globe.

His sister Ruth told the Globe he seemed fine when she saw him the previous week and had been trying to improve himself, working to move out of his mother’s apartment and get his own place, and holding a job packaging salads.

The DA’s office appointed Assistant District Attorney John Verner to lead the investigation into the police-involved shooting.

“Our priority is to conduct a full, fair, thorough investigation,” DA Dan Conley said in a statement. “When it’s complete, we will release all our findings and the complete investigative file in the interests of total transparency. For now, we’re giving the investigators the time and the tools they need to do the job right.”

Michael McCarthy arraigned in Superior Court

Michael McCarthy, the man accused of killing Dorchester toddler Bella Bond and then dumping her body in the ocean, was held without bail Monday at Suffolk County Superior Court after he pleaded not guilty to an indictment charging him with first-degree murder.

Michael McCarthy

Michael P. McCarthy

McCarthy, 35, was the boyfriend of Bella Bond’s mother, Rachelle Bond. He reportedly lived with Rachelle and Bella in Dorchester when, in late May or early June, he allegedly killed the toddler, then wrapped her up in a tarp and dumped her in the harbor in South Boston.

Bella’s body washed ashore on Deer Island at the end of June. Around the country, Bella became known as “Baby Doe” after investigators released a realistic computer-generated image of the girl, asking anyone with information to come forward and identify her.

In September, after a friend of Rachelle Bond’s tipped off authorities, and Bond and McCarthy were taken into custody. Bond was arraigned in Suffolk Superior Court earlier this week. She is charged with being an accessory after the fact, as she allegedly helped McCarthy transport and dump her daughter’s body.

Bond told investigators that Bella was crying in her room one night when McCarthy said he would quiet her. Bond alleges she walked in on McCarthy punching Bella in the stomach, and seeing the toddler’s face swollen and gray.

In court Monday, McCarthy’s lawyer suggested that Rachelle killed Bella, and lied to prosecutors. According to the Boston Globe:

Shapiro said an autopsy of the girl, who became known worldwide as “Baby Doe,” showed no signs of trauma or broken bones. That, he said, contradicts prosecutors’ allegations — and Bond’s own account — of how McCarthy repeatedly struck the child’s midsection until her face was swollen and gray.

“There’s no forensic evidence and no DNA evidence” to link McCarthy to the crime, Shapiro said. “[Rachelle Bond] is far more likely to have killed Bella.”

McCarthy is due back in court on Feb. 16.

Mattapan man held without bail for 2013 South Boston homicide

A judge ordered 26-year-old Jonathan Matos held without bail as he awaits trial for the 2013 murder of 18-year-old Jonathan Reyes.

Matos, of Mattapan, is charged with first-degree murder, unlawful possession of a firearm, and unlawful possession of a large-capacity feeding device. A grand jury indicted Matos on Friday, Dec. 4.

Matos allegedly shot Reyes multiple times outside the home on West 2nd Street where Reyes was staying, just before 3 a.m. on Jan. 6, 2013.

Assistant District Attorney Mark Zanini said in court Monday that the homicide was drug-related, and that Reyes had begun to sell drugs to users who had previously been buying from Matos. According to the Suffolk County District Attorney’s office:

Zanini told the court that Matos and a small group of associates routinely sold heroin in the area of the D Street housing development in the fall of 2012. In the course of this activity, he was known to carry a handgun. Also in the fall of 2012, Reyes moved to South Boston and joined Matos in the drug trade. Over a period of months, however, Reyes began to sell to drug users who had previously purchased from Matos’ group.

“This situation led to hostility between the parties, impinging on a lucrative drug trade,” Zanini said. “This hostility led Matos and others to confront Reyes.”

After a series of phone calls in the late night hours of Jan. 6, 2013, into the early morning hours of the following day, Matos and others travelled to the West 2nd Street residence where Reyes was staying. Reyes came outside and was shot to death by Matos and his companions, who used a large-capacity semiautomatic pistol, Zanini said.

Matos will appear in court again on Jan. 12, 2016.
